Welcome to FiveDinners! Every week we provide our customers with healthy, affordable and delicious meal plans that are simple to prepare and take the stress out of getting dinner on the table.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding contract between you (“you”, “your”, or “User”) and FiveDinners Limited (“FiveDinners”, “we”, “us”, or “our”) and govern your access to and use of the FiveDinners website, mobile applications, software, content, subscriptions, meal plans, and related services (collectively, the “Services”).
Where you download or access a mobile application through the Apple App Store, Google Play or another third-party application marketplace (“App Store”), your use of that App Store is also subject to its applicable terms and policies. If there is any conflict concerning payment processing, subscription management, cancellation or refunds for a purchase made through an App Store, the applicable App Store terms shall take precedence.
By accessing, browsing, registering for, or using any part of the Services, you confirm that you have read, understood and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated by reference – you can also read our Privacy Policy here.
If you do not accept these Terms, you must not access or use the Services.
You confirm that you are 18 years of age or older and legally capable of entering into a binding contract under the laws of England and Wales.
2. Amendments to Terms
We reserve the right to amend, update or replace these Terms at any time. All updates will be posted on the Services and shall take effect immediately upon publication.
Your continued use of the Services following publication of updated Terms shall constitute your acceptance of such amendments. It is your responsibility to review the Terms periodically.
3. Access, Registration and Account Security
To access certain Services, you may be required to create an account and provide personal information.
You warrant that:
- All information provided is true, accurate and complete
- You will keep your information updated
- You will maintain the confidentiality of your login credentials
You are solely responsible for all activity occurring under your account, whether authorised by you or not. You must notify us immediately of any unauthorised use or security breach.
You may request deletion of your account by contacting FiveDinners through the contact page within the App or through the account website. Certain information may be retained where reasonably necessary to comply with legal obligations, resolve disputes, prevent fraud or enforce our agreements, as explained in our Privacy Policy.
Deleting your account may permanently remove your saved meal plans, preferences and other account information. Account deletion and subscription cancellation are separate processes. You should cancel any active subscription before requesting account deletion.
We reserve the right to suspend or terminate any account we reasonably believe to be fraudulent, compromised, or in breach of these Terms.
Your data may be stored and processed within the United Kingdom or other jurisdictions in accordance with our Privacy Policy.
4. Mobile Application Use
You are responsible for ensuring that your device, operating system and internet connection meet the technical requirements necessary to use the App.
We may release updates, upgrades, fixes or new versions of the App. Some updates may be required for continued access to the Services, security or compatibility. We cannot guarantee that the App will remain compatible with every device or operating-system version.
You may only use device permissions and features requested by the App, including notifications, in accordance with the choices made through your device settings. You may change these permissions at any time, although disabling certain permissions may affect the operation of particular features.
Mobile network, data and internet charges imposed by your provider remain your responsibility.
Apple, Google and other App Store providers are not responsible for providing maintenance or support for the FiveDinners App, except to the extent required under their applicable terms.
5. Intellectual Property Rights
All content, materials, software, designs, trademarks, recipes, meal plans, text, graphics, audiovisual materials, brand identifiers and proprietary systems (“Content”) are the exclusive property of FiveDinners or its licensors and are protected by copyright, trademark and other intellectual property laws.
You are granted a limited, revocable, non-exclusive, non-transferable licence solely to access and use the Content for personal, household, non-commercial purposes.
You shall not:
- Copy, reproduce, distribute, display or exploit Content for commercial purposes
- Reverse engineer, decompile or attempt to extract source code
- Scrape or harvest data or content
- Remove copyright or proprietary notices
Unauthorised use shall constitute a material breach of these Terms.
6. Acceptable Use and Prohibited Activities
You agree that you shall not misuse the Services including, without limitation:
- Breaching any applicable law or regulation
- Circumventing security features or access controls
- Introducing malware, viruses or harmful code
- Interfering with system integrity or performance
- Engaging in abusive, defamatory or unlawful conduct
We reserve the right to investigate, restrict or permanently terminate access where misuse is suspected.
7. Subscriptions, Billing and Renewals
FiveDinners operates as a subscription-based service. Subscription prices, billing periods, renewal terms and any applicable trial period will be clearly displayed before purchase.
Subscription fees are payable in advance and subscriptions automatically renew for the same billing period unless cancelled before the renewal date.
Subscriptions purchased directly from FiveDinners may be managed or cancelled through your FiveDinners account or by contacting us. Cancellation will take effect at the end of the current paid billing period, unless otherwise required by law.
Where a subscription is purchased through the Apple App Store, Google Play or another App Store, payment will be processed by that App Store and the subscription must be managed or cancelled through the relevant App Store account. FiveDinners cannot directly cancel, amend or issue refunds for subscriptions processed by an App Store, except where the relevant App Store permits us to do so.
Cancelling a subscription does not automatically delete your FiveDinners account. Similarly, deleting the App from your device or deleting your FiveDinners account does not necessarily cancel an active subscription purchased through an App Store. You must cancel the subscription separately through the relevant App Store.
Free or discounted trials may automatically convert into paid subscriptions unless cancelled before the trial expires. The applicable price and conversion date will be displayed before the trial begins.
We may change subscription prices by giving reasonable advance notice. For subscriptions purchased through an App Store, any price change may also be subject to that App Store’s procedures and requirements.
Refunds will be provided where required by applicable law. Any additional refund request relating to an App Store purchase must be submitted through the relevant App Store.
8. Suspension and Termination
We may suspend or terminate access immediately and without notice where:
- These Terms have been breached
- Fraud, abuse or misuse is suspected
- We consider termination necessary to protect our legal or commercial interests
Where termination occurs without breach, any refund is entirely at our discretion and shall not exceed the pro-rata unused portion of the subscription.
9. User Submissions
By submitting any content, including recipes, reviews, comments or images (“User Content”), you grant FiveDinners a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, reproduce, distribute and publicly display such content.
You warrant that you own or control all necessary rights and that your content does not infringe third-party rights or violate any law.
We reserve the right to remove content without notice.
10. Nutritional and Dietary Guidance
FiveDinners provides meal plans, recipes, nutritional information, dietary guidance and recipe suitability indicators using a combination of:
- automated systems;
- artificial intelligence technologies;
- data-driven modelling; and
- human review and nutritional consultants where applicable.
Our content is developed with reference to recognised UK guidance, including publications from the NHS, UK Government dietary recommendations and other recognised nutritional frameworks. However, all information is provided for general informational purposes only and is not intended to constitute medical advice, nutritional therapy, dietetic advice or any other form of professional healthcare advice.
Recipe classifications and guidance (including, but not limited to, Vegetarian, Vegan, Pregnancy, Menopause, Men’s Health, Type 2 Diabetes, High Protein, Over-65s, allergen information and nutritional values) are intended solely as general guidance to assist users in making informed choices. They should not be relied upon as a substitute for professional medical, nutritional or dietary advice.
You acknowledge and agree that:
- nutritional science, dietary guidance and medical recommendations change over time;
- artificial intelligence and automated systems may generate inaccuracies, omissions or errors;
- recipes, nutritional information, allergen data and dietary classifications may not always be complete, accurate or suitable for your individual circumstances;
- ingredient formulations and manufacturing processes may change without notice;
- all nutritional values, portion sizes, calorie calculations and dietary classifications are estimates unless expressly stated otherwise.
FiveDinners does not warrant or guarantee:
- that any recipe, meal plan or recommendation is suitable for your individual circumstances;
- the completeness or accuracy of nutritional information, allergens, ingredients, calorie counts or dietary classifications;
- that any recipe is free from allergens or cross-contamination;
- that following any meal plan or recommendation will achieve any particular health, medical, nutritional, weight-loss, fitness or performance outcome.
You remain solely responsible for determining whether any recipe, ingredient, meal plan or recommendation is appropriate for you and for anyone for whom you prepare food. You should always:
- check ingredient labels and allergen information supplied by manufacturers;
- ensure food is stored, prepared and cooked safely;
- seek advice from an appropriately qualified healthcare professional before making significant dietary changes or relying on any dietary guidance, particularly if you are pregnant, breastfeeding, have allergies or intolerances, suffer from any medical condition, are taking medication, or have specific dietary requirements.
To the fullest extent permitted by law, FiveDinners shall not be liable for any loss, damage, illness, injury, adverse reaction or other consequence arising from reliance upon, or use of, any recipe, meal plan, nutritional information or dietary guidance provided through the Services. Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited under applicable law.
11. Service Availability
We do not guarantee uninterrupted availability of the Services. Planned maintenance, system upgrades, outages, cyber incidents or external provider failures may result in temporary service disruption.
We shall not be liable for any loss arising from service unavailability.
12. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied or statutory.
To the fullest extent permitted by law, we disclaim all implied warranties including, but not limited to, merchantability, satisfactory quality, fitness for purpose and non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law, FiveDinners shall not be liable for:
- Indirect, incidental or consequential losses
- Loss of profits, revenue or data
- Personal health outcomes arising from use of meal plans
14. Indemnity
You agree to indemnify and hold harmless FiveDinners against all claims, damages, losses, costs and expenses (including legal fees) arising from your breach of these Terms or misuse of the Services.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
16. Assignment
We may assign or transfer our rights and obligations without restriction. You may not assign your rights without our prior written consent.
17. Severability
If any provision of these Terms is found unenforceable, the remainder shall continue in full force and effect.
18. Entire Agreement
These Terms and any referenced policies constitute the entire agreement between you and FiveDinners and supersede all prior agreements. arising from the consumption of meals or ingredients provided through the Site.
